Terms of Service

These Terms of Service (“Terms”) govern your use of the Dynamic Roofing & Exteriors website at dynamic-roof.com (the “Site”), our online estimate request form, and our SMS/text messaging program (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

1. About Us

The Services are operated by Dynamic Roofing & Exteriors, located at 128 North 85 East Street, Orem, Utah 84057. References to “we,” “us,” or “our” in these Terms mean Dynamic Roofing & Exteriors.

2. Eligibility

You must be at least 18 years old and able to enter into a legally binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.

3. Estimates & Service Requests

Submitting an estimate request through the Site does not create a binding agreement to perform work. Any estimate we provide is based on the information you supply and our visual inspection. Final pricing, scope, and timelines will be set forth in a written proposal or contract that you sign before any work begins.

You agree to provide accurate, current, and complete information when you submit an estimate request. We may decline to provide an estimate or services in our sole discretion.

4. SMS / Text Messaging Terms

By checking the optional SMS opt-in box on our estimate request form, you agree to these additional terms governing our text messaging program:

• Program description.You will receive recurring text messages from Dynamic Roofing & Exteriors at the mobile number you provided. Message types include estimate updates, appointment reminders, project status updates, customer service responses, and occasional promotional offers.
• Consent is not a condition of purchase. You can receive an estimate and our services without opting in to text messages.
• Message frequency. Message frequency varies based on your project activity and engagement.
• Message and data rates. Standard message and data rates from your wireless carrier may apply.
• Opt-out. You may opt out of the text messaging program at any time by replying STOP to any message we send. After replying STOP, you will receive a one-time confirmation message and no further marketing messages.
• Help. Reply HELP to any message for support, or contact us at (385) 384-4471 or info@dynamic-roof.com.
• Eligible carriers. Our messaging program is available on most major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.
• Number changes. You agree to notify us promptly if the mobile number you provided changes or is no longer yours.

5. Acceptable Use

You agree not to:

• Use the Services in any way that violates any applicable federal, state, local, or international law.
• Submit false, misleading, or fraudulent information, including a mobile number you do not own or have permission to use.
• Attempt to interfere with, compromise, or disrupt the Services, the Site, or any servers or networks connected to them.
• Use the Services to send spam or unsolicited communications, or to harvest information about other users.

6. Intellectual Property

The Site and all content, design, text, graphics, logos, and software are owned by or licensed to Dynamic Roofing & Exteriors and are protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from the Site or its content without our prior written permission, except as expressly permitted by law.

7. Disclaimers

The Site and the information on it are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free from viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, Dynamic Roofing & Exteriors and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services. Our total liability for any claim arising out of or related to the Services will not exceed one hundred dollars (US $100). These limits do not apply where prohibited by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Dynamic Roofing & Exteriors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Services.

10. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to the personal jurisdiction of those courts.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of the page. Your continued use of the Services after we post changes constitutes your acceptance of the updated Terms.
